These Terms & Conditions (T&Cs) govern the sale and purchase of all products through the leedskoi.co.uk website. By placing an order with us, you agree to be bound by these terms.

2. Order Acceptance and Contract Formation
2.1. Placing an Order: By clicking the “Place Order” button at checkout, you submit an offer to buy the goods at the price stated.
2.2. Order Confirmation: After placing an order, you will receive an automated email from us acknowledging receipt of your order details. This email is for information only and does not constitute acceptance of your order.
2.3. Contract Formation: A binding contract between us (the Contract) is formed only when we dispatch the goods and send you an email confirmation that the goods have been dispatched.
2.4. Refusal of Order: We reserve the right to refuse any order for any reason, including but not limited to: * The product being unavailable from stock. * Error in the product price or description. * Failure to obtain authorisation for payment. * Inability to deliver to the postcode supplied (see Delivery Policy).
3. Pricing and Payment
3.1. Pricing: All prices displayed on the website are in Pounds Sterling (£)
3.2. Shipping Costs: Delivery charges are calculated based on weight and order value and are displayed at the checkout stage. Our full shipping structure, including our FREE UK Mainland Shipping over £50 offer, is outlined in our dedicated Shipping Policy.
3.3. Payment Security: Payment must be made at the time of order via the accepted payment methods (e.g., Stripe, PayPal, major credit/debit cards). We do not store customer financial information.
4. Delivery, Risk and Ownership
4.1 Delivery Attempts: We will attempt to deliver your goods to the address provided. If the courier is unable to complete the delivery after two attempts due to no one being home or lack of access, the goods will be held at the local depot.
4.1a Redelivery Fees: Any subsequent delivery attempts (3rd attempt onwards) requested by the customer will incur a redelivery fee, which must be paid in full before the courier is dispatched.
4.1b Failed Delivery Returns: If an order is returned to Leeds Koi after multiple failed delivery attempts or a lack of response from the customer, we will treat the contract as cancelled. We will refund the purchase price minus the direct costs of the return carriage charged by the courier.
4.2 Safe Place Requests: If you (the customer) request that a courier leaves an item in a “Safe Place” (e.g., a porch, vennel, garden, or with a neighbour), you do so entirely at your own risk.
4.2a Proof of Delivery: Once the courier has provided a photo or GPS confirmation of delivery to the requested safe place, the risk passes to you. Leeds Koi and Pond Centre will not be liable for any subsequent loss, theft, or damage.
4.3 Palletised Deliveries: Large items (Filters, Nets, Tanks) may arrive on a pallet. These are “kerbside” deliveries. It is the customer’s responsibility to ensure they are available to receive and move the item. Failed pallet deliveries incur significantly higher redelivery fees than standard parcels.
5. Returns and Cancellation
5.1 Right to Cancel: You have a legal right to cancel within 14 days of receipt. However, the “Free Returns” promise on our website applies only to authorized returns via our RA (Return Authorization) process.
5.1a Unauthorized Returns: If an item is returned to us because it was “Refused” at the door or because of “Failed Delivery,” the customer is responsible for the return shipping costs. These will be deducted from the final refund.
5.2 Non-Returnable Items: For safety and hygiene (contamination risk), we cannot accept returns for the following items if they have been opened, used, or installed:
Filter Media, Food, Water Treatments/Additives.
Pond Nets and Bowls.
Pipework and Bottom Drains.
Any item not in its original, sealed packaging.
5.3 Loss in Value: If a returned item shows signs of handling beyond what is necessary to establish the nature of the goods (e.g., a net that has been unpacked and assembled), we reserve the right to deduct up to 20% of the item’s value from your refund.
6. Limitation of Liability
6.1. Product Suitability: Products sold are intended for use as specified by the manufacturer (e.g., pond use only). We do not accept liability for loss or damage arising from the incorrect use or application of any product, including chemicals and treatments.
6.2. Maximum Liability: Our total liability to you for any loss or damage arising in connection with this Contract shall not exceed the total price of the products and delivery charges paid by you.
7. Intellectual Property
7.1. Our IP: The design of this website, our logo, unique promotional graphics, and original text content are the intellectual property of Leeds Koi and Pond Centre and are protected by copyright.
7.2. Third-Party Content: Images, product specifications, and some product descriptions on this website are used under license from our suppliers and manufacturers. These materials remain the intellectual property of their respective owners.
7.3. Usage Restrictions: You may not reproduce, duplicate, copy, or otherwise exploit any content (including images, descriptions, or logos) from this website for any commercial purpose without the express written permission of Leeds Koi and Pond Centre or the respective copyright owner.
8. Governing Law
These Terms & Conditions, and any contract formed between you and us, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
